1. Introduction
Welcome to Comfort Oasis Senior Care Solutions (“Company”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern the provision of senior care services (“Services”) to clients and their families (“Client”, “you”, or “your”). By engaging our Services, you agree to be bound by these Terms.
2. Scope of Services
We provide non-medical assistance including but not limited to:
Companionship
Personal care (grooming, hygiene assistance)
Meal preparation
Light housekeeping
Medication reminders
Transportation and errands
3. Client Responsibilities
Clients and/or legal representatives agree to:
Provide accurate health and personal information
Ensure a safe environment for care staff
Notify us of any changes in care needs or medical status
Treat staff with respect and dignity
4. Payment Terms
All services are billed (semi-monthly) based on the selected care plan.
Payment is due [upon receipt / within 7 days of invoice].
Late payments may incur a [5%] fee after [10] days past due.
We reserve the right to suspend services due to non-payment.
5. Cancellations and Termination
Services may be canceled with [48] hours' notice.
Cancellations with less than [48] hours' notice may incur a fee.
Either party may terminate services with [14] days' written notice.
We reserve the right to immediately terminate services for abuse, unsafe conditions, or noncompliance.
6. Limitation of Liability
We are not liable for:
Any injury or loss resulting from false or incomplete information provided by the Client
Medical emergencies, unless caused directly by our gross negligence
Loss or damage of personal property unless due to intentional misconduct
Maximum liability is limited to the fees paid for services in the [previous 30 days].
7. Confidentiality and Privacy
We comply with applicable privacy laws and maintain strict confidentiality regarding all client information. Client information will only be shared with authorized persons or as required by law.
8. Background Checks and Staff Training
All care staff undergo background checks and training in elderly care and safety. However, we do not guarantee compatibility between caregiver and client.
9. Governing Law
These Terms are governed by the laws of the Province of Alberta, without regard to its conflict of law provisions.
10. Modifications
We may modify these Terms with [15] days' notice. Continued use of our Services after the effective date of the changes constitutes your acceptance.
